These Terms of Service apply to the website https://viktoria-vigh.com/ and purchases made from Viktoria Vigh Consumables IKE, also registered under the short name VVC IKE, trading through VVC SHOP Sitia (“VVC”, “we”, “us” or “our”).

By using this website or placing an order, you agree to these Terms, together with the policies linked below. Nothing in these Terms limits any mandatory rights available to you under applicable consumer law.

2. Online Store and Eligibility

You must have the legal capacity required under the law applicable to you to place an order. If you permit a minor to use this website, you remain responsible for their use to the extent permitted by law.

You may not use the website, our products or our services for an unlawful or unauthorised purpose, introduce malicious code, interfere with the website’s security or operation, scrape or misuse personal information, infringe intellectual property rights, or engage in fraudulent, abusive or misleading activity.

3. Website Platform

Our online store is hosted by Shopify. Shopify provides the e-commerce platform that enables us to display and sell products and services. Your use of the website and our processing of personal information are also subject to our Privacy Policy.

4. Product Information and Availability

We aim to describe and display products, colours, dimensions, materials, availability and prices accurately. Colours may appear differently depending on your screen and lighting. Handmade products and natural materials may show small variations that are part of their individual character and are not necessarily defects.

Products may be available in limited quantities. We may change or discontinue products and may set reasonable purchase limits. Any restriction will be applied in accordance with applicable law and will not affect orders already accepted unless there is a lawful reason to cancel them.

5. Prices, Taxes and International Orders

Prices are displayed in the currency shown in the store. Taxes included in the displayed price, where applicable, and shipping charges are shown before checkout. For deliveries outside the European Union, import duties, import VAT, customs charges, brokerage fees or other destination-country charges may apply and are not included in the online product price unless expressly stated.

B2B customers must contact us for a quotation before ordering where they require B2B pricing, reverse-charge treatment, customs documents, a certificate of origin or internal or specialist shipping documentation. Those services and documents are not included in the product price unless expressly included in a written quotation.

6. Orders and Contract Formation

Submitting an order is an offer to purchase. An automated order acknowledgement confirms receipt but does not necessarily mean that we have accepted the order. A binding sales contract is formed when we expressly accept the order or dispatch the goods, subject to any mandatory rule that provides otherwise.

We may refuse or cancel an order for a legitimate reason, including unavailability, an obvious pricing or description error, failed or unauthorised payment, suspected fraud, legal or destination restrictions, or an unreasonable quantity inconsistent with ordinary retail use. If we cancel after payment, we will refund the amount paid for the cancelled item or order without undue delay. We will not cancel or alter an accepted consumer order arbitrarily.

7. Billing and Account Information

You agree to provide accurate, complete and current billing, delivery and contact information. You are responsible for keeping account login details confidential and for activity carried out through your account, except where applicable law provides otherwise. Contact us promptly if you believe your account or payment information has been used without authorisation.

8. Payment

Available payment methods are displayed at checkout. Payment services may be provided by third-party payment providers under their own terms and privacy notices. We do not store full payment-card details where payment is processed by an authorised payment provider.

9. Delivery and Collection

Shipping options, estimated delivery times, tracking, international charges, collection-only products and any expressly agreed B2B EXW terms are governed by our Shipping Policy. Delivery estimates are not guaranteed unless we expressly agree otherwise, but mandatory consumer delivery rights remain unaffected.

10. Returns, Withdrawal, Refunds and Legal Guarantee

Our voluntary return arrangements, the statutory withdrawal right for eligible EU and EEA distance purchases, exceptions, refund procedures and the EU model withdrawal form are set out in our Refund Policy.

For eligible EU consumer purchases, mandatory rights include a minimum two-year legal guarantee for goods that are faulty or do not conform to the contract. Depending on the circumstances, remedies may include repair, replacement, a price reduction or termination of the contract and a refund. These statutory rights are separate from and are not reduced by any voluntary return policy or commercial warranty.

Where legally required, an electronic withdrawal function must also be made available through the online store. The policy text itself does not replace that technical function.

11. Optional Tools and Third-Party Services

The website may provide access to third-party tools, integrations or links. Third parties operate under their own terms and privacy notices. We are not responsible for third-party websites or services that we do not control, but this does not exclude any responsibility that cannot lawfully be excluded.

12. Intellectual Property

Unless otherwise stated, the website, its design, text, graphics, logos, photographs and other content are owned by or licensed to VVC IKE and are protected by applicable intellectual property laws. You may use the website for personal, non-commercial shopping purposes. You may not reproduce, distribute, publish, sell, exploit or create derivative works from our content without prior written permission, except where the law permits.

13. Reviews, Feedback and Submissions

If you submit a review, photograph, comment, suggestion or other content, you confirm that you have the right to submit it and that it is accurate, lawful and does not infringe another person’s rights. You grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, adapt, translate and display that content for operating and promoting our business, subject to applicable privacy and consumer law.

We may moderate or remove unlawful, misleading, abusive, obscene, infringing or otherwise inappropriate content. We do not claim ownership of your personal information, and our handling of personal information is governed by our Privacy Policy.

14. Errors and Corrections

We may correct genuine typographical, technical, pricing, availability or description errors. If an error materially affects an order you have placed, we will contact you where reasonably possible and offer an appropriate lawful solution, which may include confirming the corrected terms or cancelling the affected item for a full refund. Nothing in this section limits mandatory rights concerning misleading practices or contract performance.

15. Service Availability

We aim to keep the website available and secure, but we cannot promise uninterrupted or error-free access. We may temporarily restrict access for maintenance, security, legal or operational reasons. This does not affect rights relating to a purchase already made.

16. Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, deliberate misconduct, mandatory product liability, or breach of mandatory consumer rights.

For consumers, we are responsible for losses that are a foreseeable result of our breach of contract or failure to use reasonable care and skill. We are not responsible for losses that are not foreseeable, for business losses arising from a consumer purchase, or for delay or failure caused by events outside our reasonable control, except where applicable law provides otherwise.

For B2B customers, any separate written quotation, commercial agreement or Incoterms® 2020 rule expressly agreed for the order may contain additional risk and liability provisions. Mandatory legal liability remains unaffected.

17. Indemnity for Unlawful Business Use

If you use the website in the course of business, you agree to compensate VVC IKE for reasonable, documented losses arising directly from your unlawful use of the website, infringement of third-party rights or material breach of these Terms, to the extent permitted by law. This section does not apply to consumers acting outside their trade, business, craft or profession.

18. Events Outside Our Reasonable Control

We are not responsible for delay or failure caused by events outside our reasonable control, such as severe weather, transport disruption, strikes, natural disasters, war, government action, customs delays, telecommunications failure or interruption of essential services. We will take reasonable steps to minimise the impact and will inform affected customers where appropriate. Mandatory consumer rights remain unaffected.

19. Suspension and Termination of Website Use

You may stop using the website at any time. We may suspend or terminate access where reasonably necessary because of unlawful activity, fraud, a serious breach of these Terms, security risk or legal obligation. Provisions which by their nature should survive termination remain effective, including payment obligations, intellectual property protections and limitations validly agreed under applicable law.

20. Severability and No Waiver

If any provision is found unlawful, invalid or unenforceable, it will be applied to the fullest lawful extent or severed, and the remaining provisions will continue in effect. A delay or failure to enforce a right does not waive that right.

21. Entire Agreement

These Terms and the policies expressly incorporated by link form the agreement governing use of the website and online purchases, except where a separate written agreement applies. They do not exclude statements or rights that cannot lawfully be excluded.

22. Governing Law and Disputes

These Terms are governed by the laws of Greece. If you are a consumer habitually resident in another country, this choice of law does not deprive you of mandatory consumer protections available under the law of your country of residence.

Nothing in these Terms restricts a consumer’s right to bring proceedings before a court that has jurisdiction under applicable law. Before starting formal proceedings, please contact us so that we can try to resolve the matter directly.

23. Changes to These Terms

We may update these Terms for legal, regulatory, security, technical or operational reasons. The version published when an order is placed generally applies to that order unless a change is required by law or expressly agreed with you. Material changes will not be applied retroactively to your detriment where prohibited by law.
